1. Who we are

nomade ("we", "us") is a growth strategy and AI implementation studio based in Bangkok, Thailand. We are the data controller for personal data collected through nomadehq.com and our enquiry channels, under Thailand's Personal Data Protection Act B.E. 2562 (2019), the "PDPA".

2. What we collect

• When you contact us through the form or by email: your name, company, email or phone, budget range, the offer you selected, and your message.
• When we work together: business contact details of your team, and the details needed for contracts and invoices.
• When you browse this site: the site sets no cookies. It remembers your language choice (English or Thai) in your browser's local storage, which stays on your device. Our hosting provider keeps standard technical logs (IP address, browser type, page requested, time) to keep the site secure and running.

Messages sent through the contact form reach our inbox, and are saved in a private Google Sheet that only we can open.

We don't ask for sensitive data such as health, religion or biometric information. Please don't send it to us.

3. Why we use it

Each use has a legal basis under the PDPA:

We don't use your data for automated decisions that affect you, and we don't build advertising profiles.

4. Who we share it with

We share personal data only with providers that help us run the business, and only what they need:

• Google (Gmail and Google Sheets), which stores enquiries from the contact form and delivers them to our inbox.
• Cloudflare, which hosts this website and forwards email sent to our address.
• Google Fonts: to show the site's fonts, your browser connects to Google's servers, which receive your IP address.
• Accountants, legal advisers or authorities, when the law requires it.

5. Transfers outside Thailand

Some of these providers store data outside Thailand, for example in Japan, Singapore, the EU or the United States. When that happens, we rely on the safeguards allowed under Sections 28 and 29 of the PDPA, such as the provider's contractual data protection commitments, or the transfer being needed to answer your request.

6. Data in client projects

When we build systems for a client, we may handle their customers' data on their behalf. In that case the client is the data controller and we act as data processor, under a written agreement with them. That agreement, not this policy, governs that data.

Wherever possible, client data stays in accounts the client owns, and we use business-grade AI services that don't train on it.

7. How long we keep it

• Enquiries that don't become projects: up to 2 years after our last contact, then deleted.
• Client and contract records: during the work, then as long as Thai accounting and tax law requires (generally 5 years).
• Server logs: a short period set by our host, then deleted automatically.
• Language choice: in your browser until you clear it.

8. Your rights

Under the PDPA, you can ask us to:

• See and get a copy of your data
• Correct it
• Delete it
• Stop or limit using it
• Object to how we use it
• Send it to you or another company
• Withdraw your consent at any time
• Tell you how we got it

Email contact@nomadehq.com. We reply within 30 days. Withdrawing consent doesn't affect what we did before you withdrew it.

If you're not satisfied with our answer, you can complain to the Office of the Personal Data Protection Committee (PDPC) at pdpc.or.th.

9. Security

Only the people who need your data can access it. We use secured accounts and encrypted connections (HTTPS). No system is perfectly secure: if a breach puts your data at risk, we will notify the PDPC and you as the law requires.

Our services are for businesses. We don't knowingly collect data from anyone under 20, Thailand's age of majority.

10. Changes and contact

We will post any update on this page with a new date. If a change is significant, we will tell our clients directly.

2. ข้อมูลที่เราเก็บ

• เมื่อคุณติดต่อเรา ผ่านแบบฟอร์มหรืออีเมล: ชื่อ บริษัท อีเมลหรือเบอร์โทร ช่วงงบประมาณ แพ็กเกจที่เลือก และข้อความของคุณ
• เมื่อเราทำงานร่วมกัน: ข้อมูลติดต่อทางธุรกิจของทีมคุณ และข้อมูลที่จำเป็นสำหรับสัญญาและใบแจ้งหนี้
• เมื่อคุณเข้าชมเว็บไซต์: เว็บไซต์ไม่ใช้คุกกี้ แต่จะจำภาษาที่คุณเลือก (ไทยหรืออังกฤษ) ไว้ในพื้นที่จัดเก็บของเบราว์เซอร์บนอุปกรณ์ของคุณเท่านั้น ผู้ให้บริการโฮสติ้งของเราจะเก็บบันทึกทางเทคนิคตามมาตรฐาน (หมายเลข IP ประเภทเบราว์เซอร์ หน้าที่เข้าชม และเวลา) เพื่อความปลอดภัยและการทำงานของเว็บไซต์

เราไม่ขอข้อมูลส่วนบุคคลที่มีความอ่อนไหว เช่น ข้อมูลสุขภาพ ศาสนา หรือข้อมูลชีวภาพ กรุณาอย่าส่งข้อมูลเหล่านี้ให้เรา

3. วัตถุประสงค์และฐานทางกฎหมาย

การใช้ข้อมูลแต่ละประเภทมีฐานทางกฎหมายตาม PDPA ดังนี้

เราไม่ใช้ข้อมูลของคุณในการตัดสินใจอัตโนมัติที่มีผลต่อคุณ และไม่สร้างโปรไฟล์เพื่อการโฆษณา

4. การเปิดเผยข้อมูล

เราเปิดเผยข้อมูลส่วนบุคคลเฉพาะกับผู้ให้บริการที่ช่วยดำเนินธุรกิจของเรา และเท่าที่จำเป็นเท่านั้น

• Google (Gmail และ Google Sheets) ซึ่งจัดเก็บคำขอจากแบบฟอร์มติดต่อและส่งถึงกล่องอีเมลของเรา
• Cloudflare ซึ่งโฮสต์เว็บไซต์นี้และส่งต่ออีเมลที่ส่งถึงที่อยู่ของเรา
• Google Fonts: เพื่อแสดงแบบอักษรของเว็บไซต์ เบราว์เซอร์ของคุณจะเชื่อมต่อกับเซิร์ฟเวอร์ของ Google ซึ่งจะได้รับหมายเลข IP ของคุณ

5. การส่งข้อมูลไปต่างประเทศ

ผู้ให้บริการบางรายจัดเก็บข้อมูลนอกประเทศไทย เช่น ญี่ปุ่น สิงคโปร์ สหภาพยุโรป หรือสหรัฐอเมริกา ในกรณีนี้ เราอาศัยมาตรการคุ้มครองที่มาตรา 28 และ 29 ของ PDPA อนุญาต เช่น ข้อผูกพันด้านการคุ้มครองข้อมูลตามสัญญาของผู้ให้บริการ หรือการส่งข้อมูลที่จำเป็นเพื่อตอบคำขอของคุณ

6. ข้อมูลในโครงการของลูกค้า

เมื่อเราสร้างระบบให้ลูกค้า เราอาจจัดการข้อมูลของลูกค้าของลูกค้าแทนลูกค้า ในกรณีนี้ ลูกค้าเป็นผู้ควบคุมข้อมูลส่วนบุคคล และเราเป็นผู้ประมวลผลข้อมูลส่วนบุคคลภายใต้ข้อตกลงเป็นลายลักษณ์อักษร ข้อมูลดังกล่าวอยู่ภายใต้ข้อตกลงนั้น ไม่ใช่นโยบายฉบับนี้

เราเก็บข้อมูลของลูกค้าไว้ในบัญชีที่ลูกค้าเป็นเจ้าของทุกครั้งที่ทำได้ และใช้บริการ AI ระดับธุรกิจที่ไม่นำข้อมูลไปฝึกโมเดล

7. ระยะเวลาการเก็บข้อมูล

• คำถามที่ไม่ได้เป็นโครงการ: เก็บไม่เกิน 2 ปีนับจากการติดต่อครั้งล่าสุด แล้วลบ
• ข้อมูลลูกค้าและสัญญา: ตลอดระยะเวลาการทำงาน และหลังจากนั้นตามที่กฎหมายบัญชีและภาษีของไทยกำหนด (โดยทั่วไป 5 ปี)
• บันทึกของเซิร์ฟเวอร์: ช่วงเวลาสั้น ๆ ตามที่ผู้ให้บริการโฮสติ้งกำหนด แล้วลบโดยอัตโนมัติ
• ภาษาที่เลือก: อยู่ในเบราว์เซอร์ของคุณจนกว่าคุณจะล้างข้อมูล

8. สิทธิของคุณ

ตาม PDPA คุณมีสิทธิขอให้เรา

• เข้าถึงและขอสำเนาข้อมูล
• แก้ไขข้อมูลให้ถูกต้อง
• ลบข้อมูล
• ระงับการใช้ข้อมูล
• คัดค้านการใช้ข้อมูล
• โอนย้ายข้อมูลให้คุณหรือบริษัทอื่น
• ถอนความยินยอมได้ทุกเมื่อ
• แจ้งที่มาของข้อมูล

ส่งคำขอมาที่ contact@nomadehq.com เราจะตอบภายใน 30 วัน การถอนความยินยอมไม่กระทบต่อการใช้ข้อมูลที่ทำไปแล้วก่อนหน้านั้น

หากไม่พอใจคำตอบของเรา คุณสามารถร้องเรียนต่อสำนักงานคณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (สคส.) ได้ที่ pdpc.or.th

9. ความปลอดภัย

เฉพาะผู้ที่จำเป็นเท่านั้นที่เข้าถึงข้อมูลของคุณได้ เราใช้บัญชีที่มีการรักษาความปลอดภัยและการเชื่อมต่อแบบเข้ารหัส (HTTPS) ไม่มีระบบใดปลอดภัยสมบูรณ์ หากเกิดการละเมิดที่มีความเสี่ยงต่อข้อมูลของคุณ เราจะแจ้ง สคส. และแจ้งคุณตามที่กฎหมายกำหนด

บริการของเรามีไว้สำหรับธุรกิจ เราไม่เก็บข้อมูลของผู้ที่อายุต่ำกว่า 20 ปี ซึ่งเป็นผู้เยาว์ตามกฎหมายไทย โดยเจตนา

10. การแก้ไขและติดต่อเรา

หากมีการปรับปรุง เราจะประกาศในหน้านี้พร้อมวันที่ใหม่ หากเป็นการเปลี่ยนแปลงสำคัญ เราจะแจ้งลูกค้าโดยตรง
